If your company uses artificial intelligence -- chatbots, generative AI tools, automated decision-making, AI-powered recommendations -- your terms of service probably do not cover it. That is not a minor oversight. It is a liability gap that grows wider every month as regulators, courts, and consumers catch up to what AI actually does.
Most businesses adopted AI faster than their legal infrastructure could follow. The chatbot went live before anyone updated the terms. The AI-generated marketing copy shipped without anyone asking who owns it. Customer data started feeding into machine learning models without a single disclosure in the privacy policy.
Here is what your AI terms of service need to address in 2026 -- and why getting ahead of this matters more than most companies realize.
Traditional terms of service were written for a world where humans created the content, made the decisions, and processed the data. AI changes each of those assumptions.
Liability exposure. When an AI chatbot gives a customer incorrect information -- wrong pricing, inaccurate product specs, misleading guidance -- who is liable? If your terms do not address AI-generated outputs, the answer defaults to you with no limitations and no disclaimers.
Intellectual property ownership. If your product generates content using AI -- reports, summaries, images, code -- your customers will assume they own it. Without clear terms defining IP rights in AI-generated content, you are setting up disputes you cannot win cleanly.
Data use for training. Many AI tools improve by learning from user interactions. If your AI system ingests customer data to train or fine-tune models and your terms do not disclose that, you have a transparency problem regulators are increasingly willing to punish.
Consumer expectations. People expect to know when they are interacting with a machine. The gap between what customers assume and what your AI actually does is where lawsuits originate. Clear terms close that gap before it becomes a regulatory inquiry or a class action.
An effective AI section in your terms of service should cover five areas at minimum.
State plainly that your product or service uses artificial intelligence. Identify which features are AI-powered. This is not optional goodwill -- multiple jurisdictions now require it. Connecticut's Public Act 25-113 (June 2025) amended the CTDPA to mandate disclosure when businesses use personal data to train AI systems. The EU AI Act's transparency obligations under Article 50 take full effect August 2026. If your business touches users in either jurisdiction, disclosure is the law.
AI systems generate outputs that are sometimes wrong. Your terms need to disclaim liability for inaccurate, incomplete, or misleading AI-generated content. This should be specific -- not buried in a general limitation of liability clause, but called out separately so there is no ambiguity.
Draft language should make clear that AI outputs are provided "as-is," do not constitute professional advice, and that users are responsible for independently verifying AI-generated information before relying on it.
If user data feeds into AI model training, say so. Explain what data is used, how it is used, and whether users can opt out. The FTC's Operation AI Comply initiative has targeted companies for deceptive practices related to undisclosed AI data use, and state privacy laws are adding AI-specific disclosure mandates at a rapid pace.
Generative AI hallucinates. It produces confident-sounding outputs that are factually wrong. Your terms should set expectations that AI-generated content may contain errors, that the AI does not guarantee accuracy, and that outputs should not be treated as authoritative without human verification.
Where AI makes or influences consequential decisions -- hiring recommendations, credit assessments, content moderation -- disclose the role of human review in those processes. This is both a trust-building measure and a compliance requirement under emerging laws like the Colorado AI Act (SB 205), which takes effect June 30, 2026, and specifically regulates AI used in consequential decision-making.
Your terms of service tell users the rules. Your privacy policy tells them what happens to their data. When AI is involved, the privacy policy needs its own updates.
What data feeds into AI. Identify the categories of personal data that AI systems process. This includes direct inputs (what users type into a chatbot) and indirect inputs (behavioral data, usage patterns, or content that trains recommendation algorithms).
Consent and opt-out requirements. Under the Connecticut Data Privacy Act (CTDPA), consumers have the right to opt out of automated profiling that produces legal or similarly significant effects. If your AI system profiles users to make decisions about pricing, eligibility, or access, you need consent mechanisms and opt-out rights in place. AI-powered profiling falls squarely within these requirements.
GDPR Article 22. If your business serves EU users, Article 22 gives individuals the right not to be subject to decisions based solely on automated processing that produce legal or significant effects. Who owns AI-generated content? As of March 2026, the legal answer is clearer than it was a year ago -- and less favorable to companies than most assume.
In March 2025, the D.C. Circuit affirmed in Thaler v. Perlmutter that the Copyright Act requires human authorship. AI-generated works created without meaningful human creative input are not copyrightable. The U.S. Supreme Court declined to review the decision, letting the ruling stand.
The U.S. Copyright Office reinforced this in its Part 2 report (January 2025), concluding that prompts alone do not provide sufficient human control to make users the authors of AI output. Works can still be copyrightable where a human determines sufficient expressive elements -- but merely prompting a generative AI tool does not clear that bar.
What this means for your business: if you produce content using generative AI and treat it as proprietary intellectual property, you may be building on a foundation that cannot be legally protected. Your terms of service should reflect this reality rather than over-promise IP rights that courts will not recognize.
AI regulation is accelerating on multiple fronts, and companies that wait for a single federal framework will find themselves out of compliance with the patchwork that already exists.
EU AI Act. The first wave of obligations took effect August 2025, including penalties of up to 35 million euros or 7% of global turnover for prohibited AI practices. High-risk AI system requirements and transparency rules take effect August 2, 2026. If your product reaches EU users, compliance planning should already be underway.
Colorado AI Act (SB 205). Effective date pushed to June 30, 2026. Regulates AI used in consequential decisions affecting healthcare, employment, financial services, and education. Enforcement rests with the Colorado Attorney General.
FTC enforcement. The FTC's Operation AI Comply continues to target AI-related deceptive practices, including actions against companies for overstating AI accuracy and using AI in deceptive business opportunity schemes. AI marketing claims and AI-powered products must be truthful and substantiated.
Connecticut. Public Act 25-113 added AI training disclosure requirements to the CTDPA, and legislators continue to consider broader AI governance legislation modeled on elements of the EU AI Act.
Federal level. Comprehensive federal AI legislation remains absent, but FTC enforcement, Copyright Office guidance, and executive-level AI policy attention signal that businesses cannot assume a hands-off federal posture will last.
Most businesses that use AI are making at least one of these errors right now.
Using AI without updating terms of service. This is the most common and most dangerous mistake. Every AI feature your product ships without corresponding legal language is unprotected liability.
Copying a competitor's AI terms. Another company's AI disclosures were written for their product, their data practices, and their risk profile. Borrowing them creates the same problems as a generic template -- provisions that do not apply, gaps where they should not exist, and enforceability questions a court will not resolve in your favor.
Failing to disclose AI use to customers. Transparency is no longer optional. Regulators are increasingly hostile toward businesses that deploy AI without telling users, and the reputational damage can outweigh whatever competitive advantage secrecy was meant to preserve.
Assuming AI outputs are protected intellectual property. After Thaler and the Copyright Office guidance, treating AI-generated content as copyrightable without meaningful human creative input is a legal risk, not a legal right.
Ignoring state-level AI laws. Companies that operate nationally cannot afford to track only federal developments. Connecticut, Colorado, California, and a growing number of states are legislating AI requirements independently. A tech lawyer who understands these laws is not optional -- it is how you avoid discovering a new requirement through an enforcement action.
AI terms of service are not a future problem. They are a now problem. The companies that update their legal infrastructure proactively will spend a fraction of what it costs to respond to regulatory inquiries, defend lawsuits, or rebuild customer trust after an AI-related incident.
