The Section 8, Section 15 and Section 9 renewal deadlines, what the USPTO wants, and how to renew a trademark on time. The certificate arrives and the file goes in a drawer. That is the normal, reasonable thing to do, and it is also the moment a lot of businesses start quietly losing the trademark they just paid to register. A federal trademark registration is not a deed. It is closer to a license: you keep it by filing on a schedule, and if you miss a filing, the trademark registration is cancelled rather than paused. There is no grace period that lasts forever, and no letter from the government the week before it happens. The United States Patent and Trademark Office — the USPTO, and still called the trademark office by most people who deal with it — sends correspondence to the address of record, which for a lot of small companies is a lawyer they used once in 2019 or an inbox nobody opens. This is what trademark maintenance actually looks like, in the order it comes at you. ## Trademark renewal deadlines at a glance There are three trademark maintenance documents, and they arrive on two schedules. - **5th and 6th year after registration.** Section 8 declaration of continued use, with a specimen showing the trademark in commerce. Six-month grace period with an additional fee, then cancellation. - **From the 5th year onward.** Section 15 declaration of incontestability — optional, and normally filed with the Section 8. - **9th to 10th year, then every ten years.** Combined Sections 8 and 9 renewal application. Six-month grace period with an additional fee. - **At random.** A USPTO post-registration audit asking a trademark owner to prove use on more of the goods or services listed in the registration. Every renewal deadline on that list is yours to track. Nothing in trademark law obliges the USPTO to chase you. ## The 6th year after registration: file the Section 8 declaration Somewhere in the twelve months after your registration turns five, you must file a Section 8 declaration telling the USPTO the trademark is still in use. It comes with a specimen — a real-world example showing the registered trademark being used in commerce on the goods or services you registered it for. Two things trip trademark owners up here. **The window.** It opens in the 5th year and closes at the end of the 6th year after registration. There is a six-month grace period after that with an additional fee, and once the grace period closes the registration is cancelled. Not suspended. Not flagged. Cancelled. Getting back means you file a new trademark application, start examination over, and take whatever priority date you can get — which is now behind anyone who filed while you were not paying attention. **The specimen.** A specimen has to show use in commerce the way the registration describes. A logo on your website is often fine for services. For goods, a photograph of your own marketing brochure usually is not — the USPTO wants the trademark on the product, its packaging, or a point of sale. Businesses fail this step with a perfectly healthy company behind them, because what they submitted was not proof of the right thing. Practical note: you file the Section 8 through the USPTO's Trademark Electronic Application System, and there is a filing fee per class of goods or services. Fees change; check the current schedule rather than budgeting from what you paid last time. ## Filing a Section 15 declaration: trademark incontestability This one is optional, which is exactly why it gets skipped. If your trademark has been in continuous use for five straight years after registration, and no one has successfully challenged it, you can file a Section 15 declaration and make the registration **incontestable**. It is normally filed alongside the Section 8, in the same window, as one combined trademark filing. What trademark incontestability buys you is narrow and valuable. It closes off several of the grounds a competitor could otherwise use to attack your trademark rights before the Trademark Trial and Appeal Board — most usefully, the argument that the trademark is merely descriptive and never should have been registered. That is the argument a well-funded opponent reaches for when they want to use something close to your name and would rather not pay you for it, and it is a common opening move in a trademark infringement fight. You can skip it. The registration survives. But you have left open a fight you could have closed for the cost of a filing you were already making. ## How to renew a trademark: the Section 9 application for renewal This is the trademark renewal most people mean when they say the word. The trademark renewal period is ten years. The Section 9 application for renewal is due in the year before each tenth anniversary, filed together with another Section 8 declaration of use — the USPTO treats them as a combined Section 8 and 9 filing, and in practice you prepare the required renewal documents as one job. The trademark renewal process is not a re-examination of whether your trademark was a good idea. It is a check that the trademark is still in use, for the things you registered it for. That is why the specimen matters more than anything else in the filing: the question being asked is about evidence, not law. You file the renewal application within the twelve months before the anniversary, or inside the six-month grace period with an additional fee. Handled on time, renewing your trademark registration is administrative. Handled late it is not a formal renewal request at all — it is a new trademark application, a new examination, and a gap in the chain of title that shows up in every diligence review the company ever goes through. A buyer's lawyer reads the file wrapper. They will see the lapse, and they will price it. ## The USPTO audit nobody expects One more thing worth knowing, because it surprises trademark owners who did everything right. The USPTO audits a share of trademark maintenance filings at random. If your registration lists several goods or services and you filed one specimen, an audit asks you to prove the actual trademark is in use on additional items in the list. Anything you cannot prove comes off the registration. If the response is inadequate across the board, the whole registration can go. That is worth thinking about at trademark application time, not audit time. A registration listing everything the business might conceivably do looks impressive and is a liability. A registration that matches what you actually sell survives an audit without drama. ## What to actually do about it Three things, and none of them take an afternoon. **Find out what your trademark renewal deadlines are.** Every registration has them and they are public. If you do not know when your Section 8 window opens, that is the whole problem in one sentence. **Put them where a human will see them.** Not in a file. In the calendar the business actually runs on, with a reminder six months ahead of the window, because gathering a good specimen takes longer than filing does. **Check the address of record.** If USPTO correspondence goes to a trademark attorney you no longer work with, or to an inbox nobody opens, you have no early warning system at all. ## The takeaway Registering a trademark is a project. Maintaining your trademark is a schedule. The businesses that lose trademark protection are almost never the ones that got the application wrong — they are the ones who treated the certificate as the finish line and stopped opening the mail.
